Wafaqi Mohtasib (Ombudsman) Secretariat Sends Notice to Higher Education Commission

The Wafaqi Mohtasib (Ombudsman) Secretariat has sent a notice to the Higher Education Commission (HEC) regarding a complaint filed by Mr. Faraz Naeem. The complaint alleges maladministration by the HEC in the request for revival of a two-year M.A. degree program.

The notice, which was issued on June 14, 2023, calls on the HEC to redress the grievance and reply, including rebuttal, if any, within seven days. If the HEC fails to submit a reply within the specified time, the case will be decided ex-parte on the basis of available documents.

The hearing of the case will be held on July 5, 2023 at 10:00 AM in the Wafaqi Mohtasib Secretariat. The HEC is advised to depute an officer who is fully conversant with the facts of the case and authorized to give a statement or make commitments on behalf of the agency during the hearing. The officer should bring the complete record of the case and produce attested legible copies of all supporting documents, relevant laws, rules, and regulations.

The complainant, Mr. Faraz Naeem, has also been informed of the hearing. He is advised to attend the hearing proceedings on July 5, 2023, along with copies of his affidavit, CNIC, and land line/mobile number and email address, if any. He is also advised to submit his rejoinder on the report of the HEC, if so received, well before or on the date of hearing of the case.

If the complainant does not attend the hearing, no second opportunity will be provided and the decision will be taken on the basis of available record/information. If he is unable to personally attend the hearing, he can send his representative to attend the same on the scheduled date and time.

وفاق محتسب (محتسب) سیکرٹریٹ نے مسٹر فراز نعیم کی جانب سے دائر کی گئی شکایت کے حوالے سے ہائر ایجوکیشن کمیشن (ایچ ای سی) کو نوٹس بھیجا ہے۔ شکایت میں ایچ ای سی کی طرف سے دو سالہ ایم اے ڈگری پروگرام کی بحالی کی درخواست میں بدانتظامی کا الزام لگایا گیا ہے۔

نوٹس، جو 14 جون، 2023 کو جاری کیا گیا تھا، HEC سے مطالبہ کرتا ہے کہ وہ شکایات کا ازالہ کرے اور سات دنوں کے اندر جواب، بشمول تردید، اگر کوئی ہو، کا جواب دے۔ اگر HEC مقررہ وقت کے اندر جواب جمع کرانے میں ناکام رہتا ہے تو دستیاب دستاویزات کی بنیاد پر کیس کا یک طرفہ فیصلہ کیا جائے گا۔

کیس کی سماعت 5 جولائی 2023 کو صبح 10:00 بجے وفاق محتسب سیکرٹریٹ میں ہوگی۔ ایچ ای سی کو مشورہ دیا جاتا ہے کہ وہ ایک ایسے افسر کو تعینات کرے جو کیس کے حقائق سے پوری طرح واقف ہو اور سماعت کے دوران ایجنسی کی جانب سے بیان دینے یا وعدے کرنے کا مجاز ہو۔ افسر کو کیس کا مکمل ریکارڈ ساتھ لانا چاہیے اور تمام معاون دستاویزات، متعلقہ قوانین، قواعد و ضوابط کی تصدیق شدہ قابل تصدیق کاپیاں پیش کرنی چاہیے۔

شکایت کنندہ فراز نعیم کو بھی سماعت سے آگاہ کر دیا گیا ہے۔ اسے مشورہ دیا جاتا ہے کہ وہ 5 جولائی 2023 کو ہونے والی سماعت کی کارروائی میں اپنے حلف نامہ، CNIC، اور لینڈ لائن/موبائل نمبر اور ای میل ایڈریس، اگر کوئی ہو تو، کی کاپیوں کے ساتھ حاضر ہوں۔ اسے یہ بھی مشورہ دیا جاتا ہے کہ وہ ایچ ای سی کی رپورٹ پر اپنا جوابی جواب، اگر موصول ہوا ہے، کیس کی سماعت کی تاریخ سے پہلے یا اس پر جمع کرائیں۔

اگر شکایت کنندہ سماعت میں حاضر نہیں ہوتا ہے تو دوسرا موقع فراہم نہیں کیا جائے گا اور دستیاب ریکارڈ/معلومات کی بنیاد پر فیصلہ کیا جائے گا۔ اگر وہ ذاتی طور پر سماعت میں شرکت کرنے سے قاصر ہے، تو وہ اپنے نمائندے کو مقررہ تاریخ اور وقت پر حاضر ہونے کے لیے بھیج سکتا ہے۔

ایچ ای سی سے درخواست ہے کہ وہ اس معاملے کو سنجیدگی سے لے اور اس بات کو یقینی بنائے کہ شکایت کا بروقت اور تسلی بخش حل کیا جائے۔ شکایت کنندہ سے بھی درخواست کی جاتی ہے کہ وہ سماعت میں شرکت کرے اور اپنا کیس واضح اور جامع انداز میں پیش کرے۔
